MUTISQUARE TERMS & CONDITIONS

  1. INTRODUCTION

Welcome to MutiSquare.

These Terms & Conditions govern the use of the MutiSquare website, practitioner directory, online shop and related services.

By accessing or using MutiSquare, creating an account, submitting a practitioner listing, purchasing a product or using any other MutiSquare service, you agree to these Terms & Conditions.

If you do not agree with these terms, you should not use the relevant MutiSquare services.

  1. ABOUT MUTISQUARE

MutiSquare operates an online platform that may provide:

  • a directory connecting users with independent traditional healers, practitioners and related service providers;
  • practitioner profiles and contact information;
  • Featured and Promoted practitioner listings;
  • advertising and promotional services;
  • an online shop for traditional, herbal and related products;
  • marketplace functionality for products offered by approved sellers; and
  • other related online services.

The practitioner directory and the MutiSquare Shop are different parts of the platform and different terms may apply depending on the transaction.

  1. MUTISQUARE’S ROLE AS A PRACTITIONER DIRECTORY

MutiSquare provides a platform through which users can discover and contact independent practitioners.

Unless expressly stated otherwise, practitioners listed on MutiSquare are independent service providers.

They are not employees, agents, partners or representatives of MutiSquare merely because they have a listing on the platform.

MutiSquare does not itself provide the healing or consultation services advertised by independent practitioners.

  1. CHOOSING A PRACTITIONER

Users are responsible for deciding whether to contact, consult or engage a practitioner.

Users should make reasonable enquiries before paying for or using practitioner services.

A practitioner’s presence on MutiSquare does not constitute a guarantee of:

  • results;
  • qualifications beyond those specifically verified;
  • effectiveness of services;
  • honesty of every representation made by the practitioner; or
  • suitability for a particular user’s needs.
  1. VERIFIED PRACTITIONERS

Where MutiSquare displays a “Verified” status, badge or similar wording, this means only that MutiSquare has completed the particular verification checks specified by MutiSquare at that time.

Verification may include checking specified identity, contact or supporting information submitted by a practitioner.

Verification does not mean that MutiSquare:

  • guarantees the practitioner’s services;
  • certifies the practitioner’s healing ability;
  • guarantees any outcome;
  • endorses every statement made by the practitioner; or
  • accepts responsibility for the practitioner’s independent conduct.
  1. PRACTITIONER INFORMATION

Practitioners are responsible for ensuring that information submitted to MutiSquare is accurate, lawful and not materially misleading.

This includes information relating to:

  • name or practitioner name;
  • contact details;
  • location;
  • services;
  • experience;
  • photographs;
  • qualifications or supporting information;
  • consultation arrangements; and
  • other listing information.

MutiSquare may request correction, verification or removal of information where reasonably necessary.

  1. PRACTITIONER SERVICES AND RESULTS

Traditional healing and related services may involve personal, cultural or spiritual beliefs and practices.

Individual experiences and outcomes may differ.

MutiSquare does not guarantee that any practitioner will achieve a particular spiritual, personal, relationship, financial, health or other result.

Practitioners must not use the platform to make unlawful, fraudulent or materially misleading claims.

  1. MEDICAL AND HEALTH MATTERS

Information appearing on MutiSquare should not automatically be treated as a substitute for appropriate medical diagnosis, treatment or emergency assistance.

Users should seek appropriate professional healthcare where necessary.

In an emergency, users should contact the appropriate emergency or healthcare services.

Practitioners and sellers must comply with applicable laws concerning health-related representations and products.

  1. PAYMENTS MADE DIRECTLY TO PRACTITIONERS

Customers may arrange and pay consultation fees directly to practitioners.

Where payment is made directly to a practitioner, MutiSquare does not receive, hold or process that consultation payment.

The practitioner and customer are responsible for agreeing on matters including:

  • consultation price;
  • deposits;
  • appointment arrangements;
  • cancellations;
  • rescheduling; and
  • practitioner refunds.

MutiSquare cannot normally refund money that was paid directly to an independent practitioner.

  1. PAID PRACTITIONER LISTINGS

MutiSquare may offer free and paid practitioner listings.

Paid services may include:

  • Featured listings;
  • Promoted listings;
  • advertising;
  • listing upgrades;
  • subscriptions; and
  • other promotional services.

Payment for additional visibility does not mean that MutiSquare endorses or guarantees the practitioner.

  1. NO GUARANTEED RESULTS FROM ADVERTISING

Featured, Promoted or paid listings provide advertising, visibility or additional platform functionality.

MutiSquare does not guarantee that purchasing such services will produce:

  • a particular number of views;
  • enquiries;
  • consultations;
  • customers;
  • sales;
  • revenue; or
  • any particular search position at all times.
  1. THE MUTISQUARE SHOP

MutiSquare may operate an online shop through which customers can purchase products.

Products may include traditional, herbal, cultural, clothing, accessories and other goods permitted on the platform.

Products may be supplied directly by MutiSquare or, where marketplace functionality is available, by approved independent sellers.

  1. PRODUCT INFORMATION

MutiSquare and applicable sellers will take reasonable steps to provide accurate product information.

However, minor differences may sometimes occur between website photographs and the physical product, including differences resulting from packaging changes, screen displays, handmade characteristics or supplier changes.

Material product characteristics should be described accurately.

  1. PRODUCT PRICES

Product prices will be displayed on the website.

Customers should review the total amount payable before completing an order.

Prices, promotions and product availability may change from time to time.

Where a material pricing error is discovered before an order is fulfilled, MutiSquare may contact the customer and take appropriate action in accordance with applicable law.

  1. ORDERS

Placing an order does not guarantee that a product is available.

Orders may be subject to:

  • payment confirmation;
  • stock availability;
  • delivery availability;
  • fraud or security checks; and
  • applicable legal requirements.

Where an order cannot lawfully or reasonably be fulfilled, the customer will be informed and any refund due will be handled in accordance with applicable law.

  1. PAYMENTS TO MUTISQUARE

Payments for MutiSquare Shop orders, paid listings, advertising and other MutiSquare services may be processed through PayFast or another authorised payment service provider.

Customers and practitioners must provide accurate payment and transaction information.

Payment processing may also be subject to the payment provider’s applicable terms and security requirements.

  1. PAYMENT SECURITY

MutiSquare may rely on third-party payment providers to securely process payment information.

Users should not send payment card details through ordinary email, messaging or other insecure communication channels.

Users are responsible for protecting their account and payment credentials.

  1. PRODUCT AVAILABILITY

Products are subject to availability.

If payment has been received for a product that cannot be supplied, MutiSquare will provide an appropriate remedy, which may include an agreed alternative or refund as required by applicable law.

  1. DELIVERY

Physical product orders are subject to MutiSquare’s Shipping & Delivery Policy.

Customers are responsible for supplying accurate delivery information.

Delivery times displayed on the website may be estimates unless expressly stated otherwise.

  1. RETURNS, REFUNDS AND CANCELLATIONS

Returns, refunds, exchanges and cancellations relating to purchases made directly from MutiSquare are governed by the Refund, Returns & Cancellation Policy and applicable South African law.

This is separate from consultation payments made directly to independent practitioners.

  1. TRADITIONAL, HERBAL AND RELATED PRODUCTS

The MutiSquare Shop may offer herbs, roots, bark, oils, powders, incense and other traditional or related products.

Product descriptions are provided for general product information.

Unless lawfully permitted and properly supported, products should not be represented as guaranteed to diagnose, treat, prevent or cure a medical condition.

Customers should follow applicable product instructions and warnings.

Where appropriate, customers with medical conditions, allergies, pregnancy concerns or possible medication interactions should obtain suitable professional advice before using a product.

  1. INDEPENDENT MARKETPLACE SELLERS

Where MutiSquare allows independent sellers to sell products through the platform, those sellers are responsible for complying with applicable seller requirements and laws.

Seller information should be made reasonably clear where required.

MutiSquare may establish rules governing product quality, fulfilment, customer service and seller conduct.

  1. PROHIBITED PRODUCTS

MutiSquare may prohibit or remove products that:

  • are unlawful;
  • are counterfeit;
  • are stolen;
  • are materially misleading;
  • create unacceptable safety risks;
  • violate intellectual property rights;
  • cannot lawfully be sold or delivered;
  • breach MutiSquare policies; or
  • otherwise expose users or the platform to unreasonable risk.

MutiSquare may request information concerning the origin, description or legality of a product.

  1. USER ACCOUNTS

Certain MutiSquare services may require an account.

Users are responsible for:

  • providing accurate information;
  • protecting passwords and login details;
  • preventing unauthorised account access; and
  • notifying MutiSquare of suspected unauthorised use where appropriate.

Users must not impersonate another person or create accounts for fraudulent purposes.

  1. ACCEPTABLE USE

Users must not use MutiSquare to:

  • commit fraud;
  • scam or deceive others;
  • threaten or unlawfully harass others;
  • publish unlawful content;
  • impersonate another person;
  • distribute malicious software;
  • interfere with website security;
  • manipulate reviews or listings dishonestly;
  • sell prohibited products; or
  • engage in activity that violates applicable law.
  1. REVIEWS AND USER CONTENT

MutiSquare may allow customers to submit ratings, reviews, comments or other content.

Users must provide genuine opinions based on their own experiences and must not knowingly submit false, defamatory, fraudulent or manipulated reviews.

MutiSquare may moderate or remove content that violates its policies or applicable law.

  1. COMPLAINTS AND REPORTING

Users may report suspected:

  • fraud;
  • scams;
  • misleading listings;
  • impersonation;
  • inappropriate conduct;
  • prohibited products;
  • safety concerns; or
  • other serious policy violations.

Reports will be handled in accordance with the MutiSquare Complaints & Reporting Policy.

Submitting a complaint does not automatically establish that the person complained about has acted improperly.

  1. SUSPENSION AND REMOVAL

MutiSquare may investigate, restrict, suspend or remove listings, products, content or accounts where there is a reasonable basis to believe that:

  • platform policies have been materially violated;
  • information is fraudulent or materially misleading;
  • unlawful activity may be involved;
  • users may face a serious safety risk; or
  • action is reasonably necessary to protect the platform or its users.

Any applicable contractual or consumer rights will remain subject to South African law.

  1. PRIVACY AND PERSONAL INFORMATION

Personal information is handled in accordance with the MutiSquare Privacy Policy and applicable South African data-protection requirements, including POPIA where applicable.

Practitioners should understand that information intentionally submitted for publication in their practitioner profile may be visible to the public.

  1. COOKIES

MutiSquare may use cookies and similar technologies for website functionality, security, accounts, analytics and other purposes.

  1. INTELLECTUAL PROPERTY

Unless otherwise stated, the MutiSquare name, branding, website design and original platform content are owned by or licensed to MutiSquare.

Users may not copy, reproduce or commercially exploit protected MutiSquare material without appropriate permission.

Practitioners and sellers remain responsible for ensuring that photographs, logos, descriptions and other materials they upload do not unlawfully infringe third-party rights.

  1. THIRD-PARTY SERVICES

MutiSquare may use or link to third-party services including payment providers, couriers, maps, hosting services, social networks and other technology providers.

Third-party services may operate under their own terms and privacy policies.

MutiSquare is not responsible for independent third-party services beyond obligations imposed on MutiSquare by applicable law.

  1. WEBSITE AVAILABILITY

MutiSquare aims to maintain a reliable service but cannot guarantee that the website will always operate without interruption or error.

Maintenance, technical problems, security incidents or circumstances outside reasonable control may temporarily affect availability.

  1. LIMITATION OF MUTISQUARE’S ROLE

MutiSquare provides the platform and services described in these Terms.

MutiSquare is not automatically responsible for every act, statement, service or representation made independently by a practitioner, seller, customer or other third party.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

  1. INDEMNITY AND UNLAWFUL USE

To the extent permitted by law, users may be responsible for losses or claims arising from their own unlawful use of MutiSquare, infringement of third-party rights, fraudulent conduct or material breach of these Terms.

This provision does not remove rights or protections that cannot lawfully be excluded.

  1. CONSUMER RIGHTS

Nothing in these Terms is intended to exclude, restrict or waive any consumer right or remedy that cannot lawfully be excluded under applicable South African law.

This includes rights that may arise under the Consumer Protection Act, Electronic Communications and Transactions Act and other applicable legislation.

Where these Terms conflict with a mandatory legal requirement, the applicable law will prevail.

  1. CHANGES TO MUTISQUARE SERVICES

MutiSquare may introduce, change or discontinue website features, listing options, shop functionality or other services from time to time.

Where a change materially affects an existing paid service or transaction, MutiSquare will handle the matter reasonably and in accordance with applicable law.

  1. CHANGES TO THESE TERMS

MutiSquare may update these Terms & Conditions when its services, policies, business model or applicable requirements change.

The latest version will be published on the MutiSquare website with an updated “Last updated” date.

  1. GOVERNING LAW

These Terms & Conditions are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with according to applicable South African law and the jurisdiction of the appropriate courts or other legally authorised dispute-resolution bodies.
